The lawful bases upon which we process your personal data include: Consent, where you have opted in to receive recurring marketing and transactional text messages from us; and Contractual necessity or legitimate interest, where processing is required to deliver transactional updates relating to an existing order, or where it serves our legitimate interests in promoting products and services that may be relevant to you, provided those interests are not overridden by your rights and freedoms. You may withdraw your consent at any time by following the opt-out instructions within any message or by emailing support@downtonhome.com. We maintain complete records of consent and opt-out actions to ensure compliance with the UK General Data Protection Regulation (UK GDPR) and the Privacy and Electronic Communications Regulations (PECR).

Downton Home Furnishings Ltd provides its mobile messaging services (“the Program”) on an “as is” and “as available” basis. While we take all reasonable steps to ensure the reliability and quality of our messaging communications, we do not warrant that messages will be delivered without delay, error, or interruption. Message delivery is dependent on mobile carrier networks, device compatibility, and factors outside our direct control.

We make no representation or warranty, express or implied, regarding the accuracy, reliability, availability, or completeness of any content transmitted through the Program. To the fullest extent permitted by law, Downton Home Furnishings Ltd disclaims all warranties, whether express, implied, statutory or otherwise, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Downton Home Furnishings Ltd, its officers, employees, contractors, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your participation in the Program, message delivery failures, transmission errors, or technical interruptions. Nothing in this disclaimer limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under English law.

Message and data rates may apply depending on your mobile network provider. Downton Home Furnishings Ltd is not responsible for any fees or charges incurred as a result of participation in the Program.

By participating, you acknowledge that mobile messaging involves inherent risks associated with telecommunication networks and third-party carriers. Carriers are not responsible for delayed or undelivered messages, and you agree that they shall not be held liable for any losses or damages related to Program participation.

Downton Home Furnishings Ltd reserves the right to modify or discontinue the Program, in whole or in part, at any time without notice, including the right to suspend, block, or terminate messaging where misuse, abuse, or fraudulent activity is detected.

Nothing in this disclaimer affects your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015, Data Protection Act 2018, and UK GDPR.
